The purchase of any product from the online store www.eluzjoias.com.br, owned by ELUZ JOIAS E ACESSORIOS, registered under CNPJ/MF No. 41.869.396/0001-95, headquartered at Rua Ida Pasin Miele, nº 151, Centro, São Bernardo do Campo, SP, ZIP Code: 09720-280, implies the consumer's full agreement with all the terms and conditions of this Product Purchase and Sale Agreement ("Agreement").
Whereas:
(i) Eluz Joias is a company whose main activities consist of the sale of products via the internet;
(ii) The User is an individual or legal entity, duly registered with the CPF/MF or CNPJ/MF, with a properly completed registration form, whose information has been validated by Eluz Joias; and
(iii) The User declares to be acting in good faith and legally capable of entering into this Agreement, declaring that they have read, understood, and agree with all the terms and conditions herein.
PURCHASE AND SALE PROCEDURES
Clause One: After submitting a purchase request at Eluz Joias' online store, the User must await a notification email confirming the commercial transaction ("Purchase and Sale").
Paragraph One: Eluz Joias reserves the right not to confirm the Purchase and Sale in cases of (i) Users with incorrect or invalid registration information, (ii) deliveries outside the delivery areas available at the time of purchase, (iii) fraud, bad faith, breach of site policies, abuse of rights, legal violations, or unjust enrichment by the User, and/or (iv) other situations as provided for by applicable law.
Clause Two: The purchase amount will be stated in the confirmation email, and the User will be offered the payment options available on www.eluzjoias.com.br at the time of purchase.
Paragraph One: Credit card payments may not be approved in case of data inconsistencies. Bank slips generated for payment will be valid for 3 (three) business days and will be automatically canceled after this period.
RIGHTS AND OBLIGATIONS
Return Due to Withdrawal
Clause Three: Products may be returned within 30 (thirty) calendar days after receipt, in case of withdrawal ("Withdrawal").
Paragraph One: To exercise the right of Withdrawal, the User must contact our customer service team by phone or email to initiate the return process.
Paragraph Two: The User may choose to (i) be refunded via the same payment method used at purchase, or (ii) receive store credit valid for 120 (one hundred twenty) days from issuance, equivalent to the purchase amount including shipping if applicable.
Paragraph Three: The return will only be approved after (i) the product is received at Eluz Joias' distribution center, (ii) confirmation that the product is unused, in original packaging with tags, manuals, accessories, and invoice, and (iii) quality control approval, within 5 (five) business days.
Paragraph Four: If the return is not in compliance with this clause, the product will be sent back to the User without prior notice.
Exchange Due to Defect or Fault
Clause Four: Defective products can be exchanged within the legal warranty period from receipt, according to Article 26 of the Consumer Defense Code.
Paragraph One: The User must contact our customer service to initiate the exchange process.
Paragraph Two: The User may exchange for (i) a product of equal value, (ii) a product of lesser value with refund/store credit for the difference, or (iii) a product of higher value by paying the difference. Shipping for exchanges is free, but shipping from the original order will not be refunded.
Paragraph Three: The exchange will only be approved after (i) return receipt at the distribution center, (ii) confirmation that the product is accompanied by manuals, accessories, and invoice, and (iii) quality control approval within 5 (five) business days.
Paragraph Four: Products with open or damaged packaging or missing items must be reported immediately to Eluz Joias and the delivery carrier.
Paragraph Five: Exchanges not compliant with this clause will be denied, and the product will be returned without notice.
Paragraph Six: Returns can be made by postal service or scheduled pickup.
PAYMENT REFUND TIMEFRAME
Clause Five: Credit card refunds will appear on the User’s statement within up to 2 (two) billing cycles. Bank slip payments will be refunded by deposit into the account of the order holder within 5 (five) business days. Refunds will not be made to accounts other than the purchaser’s.
PRODUCTS ON SALE
Clause Six: In case of returns or exchanges of discounted items, the amount considered will be the paid price, not the original price.
DELIVERY TERMS AND CONDITIONS
Clause Seven: Products are delivered Monday through Friday from 8:00 AM to 9:00 PM, and occasionally on Saturdays during business hours. The delivery time starts only after confirmation of registration and payment, which can take up to 2 (two) business days.
Paragraph One: Deliveries are made by Correios or other transport services hired by Eluz Joias.
Paragraph Two: Deliveries may be made to third parties like doormen or relatives.
Paragraph Three: After the invoice is issued, the delivery address cannot be changed.
Paragraph Four: Delays may occur due to (i) the absence of the recipient, (ii) incorrect registration data, (iii) refusal by the recipient, (iv) address change, or (v) force majeure events like natural disasters or accidents.
Clause Eight: This Agreement ensures easy customer support, as per Article 4, IV of Decree No. 7,962/13.
Clause Nine: Eluz Joias reserves the right to cancel the transaction in cases of fraud, bad faith, policy violations, abuse of rights, legal violations, or unjust enrichment.
Clause Ten: The relationship between Eluz Joias and the User is governed exclusively by Brazilian consumer law and the terms of this Agreement.
JURISDICTION
Clause Eleven: Any disputes related to this Agreement shall be settled in the consumer's local court jurisdiction.
